Charter Renewal – Discussion and possible action regarding the request by Shonto Governing Board of Education, Inc. to accept the untimely submitted application for renewal of its charter. If the Board determines that a failure has occurred, the Board may take action as it deems appropriate or necessary under state law, which may include imposing a civil penalty of one thousand dollars per occurrence pursuant to A.R.S. § 15-185(I): a. If the Board determines that a breach remains, the Board may take action as it deems appropriate or necessary under state law, which may include issuing a notice of intent to revoke the charter pursuant to A.R.S. § 15-183(I). 4. The Board will receive information to determine whether evidence exists that Academy Del Sol, Inc. continues to breach one or more provisions of its charter contract, federal, state, or local laws regarding failure to timely submit the annual financial audit in accordance with A.R.S. § 15-183(E)(6). The Board will also consider whether evidence exists that the Charter Holder is in breach of one or more provisions of its charter contract or federal law when it failed to comply with the accounting and reporting requirements for receipt of NCLB, IDEA and ARRA funding. If the Board determines that a breach remains, the Board may take action as it deems appropriate or necessary under state law, which may include issuing a notice of intent to revoke the charter pursuant to A.R.S. § 15-183(I). 5. The Board will receive information to determine whether evidence exists that the Charter Holders listed below continue to breach one or more provisions of its charter contract, federal, state, or local laws regarding failure to timely submit the annual financial audit in accordance with A.R.S. § 15-183(E)(6). The Board will also consider whether evidence exists that the Charter Holder is in breach of one or more provisions of its charter contract or state law when it failed to provide a learning environment that improved pupil achievement. If the Board determines that a breach remains, the Board may take action as it deems appropriate or necessary under state law, which may include issuing a notice of intent to revoke the charter pursuant to A.R.S. § 15-183(I). a.
