D. Office of the Auditor General – Sunset Audit – Discussion and update on the sunset audit of the Board. Pursuant to A.R.S. § 38-431.03(A)(2), the Board may vote to go into Executive Session on this agenda item, which will not be open to the public, for the discussion or consideration of records exempt by law from public inspection, including the receipt and discussion of information that is specifically required to be maintained as confidential by state law.
E. Call to the Public – This is the time for the public to comment. Members of the Board may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to A.R.S. § 38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to any criticism, or scheduling the matter for further consideration and decision at a later date.

2. Legislative Update
I. Consent Agenda - All items on this agenda will be considered by a single motion with no discussion, unless requested otherwise by a board member. Consideration to approve the request for charter renewal and grant a renewal contract to the following:
1. Mary Ellen Halvorson Educational Foundation
2. Pathfinder Charter School Foundation
J. Surrender Agreement – Discussion and possible action on the Consent Agreement for the Voluntary Surrender and Termination of the Charter Contract for BNE Ashur.
K. Compliance Matters – Discussion and possible action.
1. The Board will receive information to determine whether evidence exists that New Destiny Leadership Charter School is in breach of one or more provisions of its charter contract, federal, state, or local laws, including but not limited to, failing to provide a program of instruction during FY 2013, failing to submit the fiscal year 2012 annual financial statement and compliance audit, and failing to submit the annual financial report. If the Board determines that a breach may have occurred the Board may issue a Notice of Intent to Revoke the Charter pursuant to A.R.S. 15-183(I).
2. The Board will receive information to determine whether evidence exists that the DCS Partners, Inc. continues to breach one or more provisions of its charter contract, federal, state, or local laws regarding failure to timely submit the annual financial audit in accordance with A.R.S. § 15-183(E)(6). The Board will also consider whether evidence exists that the Charter Holder is in breach of one or more provisions of its charter contract or state law when it failed to demonstrate compliance with federal Elementary and Secondary Education Act requirements, and failed to submit to the Board the required documentation to change its charter representative. If the Board determines that a breach may have occurred the Board may take action as it deems appropriate or necessary under state law, which may include but is not limited to adding to the basis of the withholding and issuance of a Notice of Intent to Revoke the Charter pursuant to A.R.S. § 15-183(I).
3. The Board will receive information to determine whether evidence exists that the following charter holders continue to breach one or more provisions of its charter contract, federal, state, or local laws regarding failure to timely submit the annual financial audit in accordance with A.R.S. § 15-183(E)(6). If the Board determines that a breach may have occurred the Board may take action as it deems appropriate or necessary under state law, which may include but is not limited to issuance of a Notice of Intent to Revoke the Charter pursuant to A.R.S. § 15-183(I).

M. New Charter School Applications — Discussion and possible action on the following applications and requests for a charter for applicants that provided applications that do not meet the Board’s scoring criteria but who requested that their applications be forwarded to the Board for consideration:
1. Arizona Language Preparatory - Portfolio and Interview recording Part 1 and Part 2
2. Desert Star Academy, Inc. - Portfolio and Interview recording Part 1 and Part 2

N. New Charter School Application for 2014-2015– Discussion and possible consideration of modifications to the New Charter School Application and processes for the 2014-2015 application cycle.

Board Comments and Future Meeting Dates – The executive director, presiding officer or a member of the Board may present a brief summary of current events pursuant to A.R.S. § 38-431.02(K) and may discuss future meeting dates and direct staff to place matters on a future agenda. The Board will not discuss or take action on any current event summary.
