Charter Replication Application – Discussion and possible action on the replication application and request for a charter submitted for BASIS School, Inc. for the operation of BASIS Foothills. J. Charter Renewal Application – Discussion and possible action on the renewal application for the following charter holders: 1. Chester Newton Charter and Montessori School - Part 1 , Part 2 2. New Horizon School for the Performing Arts - K. Transfer of Charter Contract – Discussion and possible reconsideration of previous action taken to deny the request of the following charter holders to transfer their charter contracts from the State Board of Education to the State Board for Charter Schools:1. Global Renaissance Academy of Distinguished Education 2. Omega Schools, Inc. L. Compliance Matters – Discussion and possible action.1. The Board will receive information to determine whether evidence exists that Sierra Summit Academy, Inc. is in breach of one or more provisions of its charter contract, federal, state, or local laws, including but not limited to, failing to provide a program of instruction during FY 2012 and failing to remain current with the Arizona Corporation Commission. If the Board determines that a breach may have occurred the Board may issue a Notice of Intent to Revoke the Charter pursuant to A.R.S. 15-183(I). 2. The Board will receive information to determine whether evidence exists that Legacy Education Group is in breach of one or more provisions of their charter contract, federal, state, or local laws relating to the education of children with disabilities. If the Board determines that a breach may have occurred, the Board may take action as it deems appropriate or necessary under state law, which may include withholding of up to 10% of the monthly apportionment of state aid and requiring a corrective action plan pursuant to A.R.S. §15-185(H), and/or issuing a notice of intent to revoke the charter pursuant to A.R.S. § 15-183(I). 3. The Board will receive information to determine whether evidence exists that the following charter holders failed to comply with the fingerprinting requirements prescribed in A.R.S. § 15-183(C) or A.R.S. § 15-512. If the Board determines that a failure has occurred, the Board may take action as it deems appropriate or necessary under state law, which may include imposing a civil penalty of one thousand dollars per occurrence pursuant to A.R.S. § 15-185(I): a. Archway Classical Academy Chandler - Staff Report and Notification and Responseb. Arizona Academy of Leadership, Inc. - Staff Report and Notification 4. The Board will receive information to determine whether evidence exists that the Charter Holders listed below are in breach of one or more provisions of their charter contract, federal, state, or local laws regarding their failure to meet the timeframes established in one or more of the following areas: failure to timely submit the annual financial audit in accordance with A.R.S. § 15-183(E)(6), and/or failure to timely submit the annual financial report in accordance with A.R.S. § 15-183(E)(6). If the Board determines that a breach may have occurred, the Board may take action as it deems appropriate or necessary under state law, which may include withholding of up to 10% of the monthly apportionment of state aid and requiring a corrective action plan pursuant to A.R.S. §15-185(H), and/or issuing a notice of intent to revoke the charter pursuant to A.R.S. § 15-183(I). a.
